1. Introduction

Welcome to Love What You Fund ("Platform," "we," "our," "us"). These Terms of Service ("Terms") govern your access to and use of lovewhatyoufund.com and related services. By using the Platform, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Platform.

2. What We Do

Love What You Fund is a discovery and storytelling platform that helps donors choose their exact impact at verified 501(c)(3) nonprofits. We provide:

  • A marketplace where nonprofits can list specific funding projects
  • Tools for donors to discover and support those projects
  • A handoff to Every.org's hosted checkout for the donation transaction
  • Communication tools and editorial content (some AI-assisted)

2.1 We Are Not the Charity of Record or the Payment Processor

Love What You Fund does not receive, hold, or disburse charitable contributions. When you click a donate button, you are sent to a hosted checkout operated by a third-party donation provider, which acts as the merchant of record for that transaction. Love What You Fund is never the merchant of record and never receives, holds, or disburses your funds. Today, that provider is Every.org, a registered 501(c)(3) public charity: Every.org receives your contribution as a tax-deductible gift, processes the payment, issues your tax receipt, and grants those funds to the nonprofit you selected, under Every.org's policies. We may add other donation providers over time.

Your transaction with Every.org is governed by Every.org's Terms and Privacy Policy. Please review them before donating.

3. Accounts

Some features require an account. You agree to provide accurate information and to keep it current. You are responsible for the security of your account and for all activity under it. Notify us immediately of any unauthorized use.

If you initiate a donation without first creating an account, we may create a minimal account associated with your email so we can attach the donation to a profile, send you receipts and updates, and let you manage your preferences. You can claim or close that account at any time.

4. For Donors

4.1 Donations

Donations are processed by Every.org. Once a donation is submitted, it is final from our perspective. Refunds, reversals, and adjustments are handled by Every.org under its policies; Love What You Fund cannot refund a donation directly.

4.2 Tax Receipts

Tax receipts are issued by Every.org, the recipient 501(c)(3), and emailed to the address you provide at checkout. Donations to Every.org are generally tax-deductible to the extent permitted by U.S. law. We do not issue tax receipts and do not provide tax advice.

4.3 Fees

Today, Love What You Fund does not charge donors a platform fee. Every.org operates a free-to-donor model and discloses any optional tip or payment-processing fee directly on its checkout page; we are not involved in that pricing.

We reserve the right to introduce, modify, or remove fees — including platform fees, service charges, optional tips, suggested donations to Love What You Fund, or other charges — at our sole discretion and at any time. Any such fee will be clearly disclosed at the point it applies to a transaction (for example, on the relevant nonprofit, project, or checkout page) before you confirm. Your continued use of the Platform after a fee change is announced or disclosed constitutes acceptance of that change.

4.4 Geographic Availability

Charitable solicitation and fundraising are regulated at the state level, and Love What You Fund operates in a limited number of U.S. states. Donate options are shown only to visitors located in states we actively support. We do not knowingly enable donations to, feature, or solicit on behalf of nonprofits in states where doing so would require charitable fundraising-platform, professional-fundraiser, or fundraising-counsel registrations we have not obtained. The set of supported states may change as we expand or complete additional registrations. If donating is unavailable in your location, you can still browse nonprofits and learn about their work.

4.5 Anonymity

You may mark a donation anonymous. Your name will not be shown publicly on the Platform, but the receiving nonprofit and Every.org may still see identifying information as required for tax receipts and compliance.

5. For Nonprofits

5.1 Eligibility

Only organizations with current 501(c)(3) status with the IRS may register or be represented as nonprofits on the Platform. We verify against IRS records and require domain-based email verification for staff accounts.

5.2 Representations

By registering or claiming a nonprofit, you represent that:

  • Your organization maintains active 501(c)(3) status
  • You are authorized to act on behalf of the organization
  • Project descriptions and statements about fund usage are accurate and not misleading
  • Funds will be used as represented
  • You will comply with applicable charitable solicitation laws

5.3 State Charitable Solicitation Compliance

Many states require nonprofits to register before soliciting donations from residents. You are solely responsible for maintaining required registrations and for the accuracy of any state-required disclosure language. The Platform offers visibility controls and disclosure display, but does not guarantee compliance and is not legal counsel.

We currently enable donations only for nonprofits and donors connected to the limited set of U.S. states we support. If your organization is located in or solicits from a state we do not yet support, donations through the Platform may be unavailable to it until we expand into that state.

5.4 Receiving Funds

Because your donation provider (currently Every.org) is the merchant of record, your nonprofit does not need to set up a payment processor or merchant account through the Platform. Every.org identifies eligible 501(c)(3) organizations by EIN and disburses granted funds under its own policies. To update bank details, claim funds, or ask about disbursement, contact Every.org directly.

5.5 Nonprofit Fees

Today, Love What You Fund does not charge nonprofits a platform fee or subscription. We reserve the right to introduce, modify, or remove fees for nonprofit features at any time and at our sole discretion — including platform fees, subscription tiers, paid features, premium placements, or transaction-related charges. Any such fee will be disclosed in advance, and your continued use of the affected feature after a fee takes effect constitutes acceptance.

5.6 Editorial Coverage

The Platform may publish editorial content about nonprofits — listings, articles, summaries, and outreach — some of which is generated or assisted by artificial intelligence under human editorial review. Coverage does not constitute endorsement and does not guarantee donations or any specific outcome. Contact us to request correction of factual inaccuracies.

5.7 Promotional Cooperation

If we feature or promote your organization — through editorial content, listings, or outreach — we may ask you to acknowledge or link to Love What You Fund, for example by adding a link or badge on your website noting that you accept donations through the Platform. Any such request is optional and is not a condition of being featured, of donations reaching your organization, or of your continued use of the free Platform. If we later offer paid, premium, or promotional features for which attribution or a reciprocal link is a condition, we will disclose that clearly when the feature is offered, and you may decline it.

6. Acceptable Use

You agree not to:

  • Provide false or misleading information, or impersonate others
  • Use the Platform for fraudulent or unlawful purposes
  • Attempt to circumvent geographic, eligibility, or solicitation controls
  • Attempt to gain unauthorized access to the Platform or other accounts
  • Interfere with or disrupt the Platform's operation
  • Scrape or harvest data without authorization
  • Send spam or unsolicited communications via the Platform
  • Violate applicable laws or regulations

7. Intellectual Property

The Platform and its content, features, and functionality are owned by Love What You Fund and protected by copyright, trademark, and other laws.

Nonprofits retain ownership of content they submit (project descriptions, images, logos, updates) and grant us a non-exclusive, royalty-free, worldwide license to display, reproduce, and lightly edit (for formatting and editorial purposes) that content on the Platform and in related communications, for as long as reasonably necessary to operate the service.

7.1 Copyright Complaints (DMCA)

We respond to notices of alleged copyright infringement under the Digital Millennium Copyright Act (17 U.S.C. § 512). If you believe content on the Platform infringes a copyright you own or control, send a written notice to our designated agent:

Your notice must include the elements required by 17 U.S.C. § 512(c)(3), including identification of the copyrighted work, the material you believe is infringing and where it is located, your contact information, a good-faith statement, and your physical or electronic signature. We may remove or disable access to the material and will terminate the accounts of repeat infringers in appropriate circumstances.

8. AI-Assisted Content

Some Platform content — including listings, summaries, articles, and outbound communications — may be generated or assisted by artificial intelligence with human review. We make reasonable efforts to ensure accuracy, but AI-generated content can contain errors. Please contact us about any factual inaccuracies.

9. Disclaimers

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not guarantee that the Platform will be uninterrupted, secure, or error-free. We do not endorse any nonprofit or project, and we do not guarantee that funds will be used as represented or that projects will achieve their stated goals. Donors should conduct their own due diligence.

We are not responsible for the acts, omissions, downtime, fees, disbursement timing, or policies of Every.org or any other third-party service.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LOVEWHATYOUFUND AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF THE PLATFORM.

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE PLATFORM SHALL NOT EXCEED THE GREATER OF $100 OR THE AMOUNT OF FEES YOU PAID DIRECTLY TO LOVEWHATYOUFUND IN THE 12 MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify and hold harmless Love What You Fund and its affiliates, officers, directors, employees, and agents from any claims, losses, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Platform, your violation of these Terms, your violation of third-party rights, or — for nonprofits — your representations about your organization, projects, or use of granted funds.

12. Dispute Resolution

Any disputes arising from these Terms shall be resolved through binding arbitration under the American Arbitration Association's rules, conducted in Illinois. You agree to waive any right to participate in a class action or class-wide arbitration, except where such waiver is prohibited by law.

13. Termination

We may terminate or suspend your account and access to the Platform at any time, with or without notice, for any reason, including breach of these Terms. Donations already initiated and held by Every.org will be processed and disbursed by Every.org under its own policies regardless of your Platform account status.

14. Changes

We may modify these Terms at any time. We will post the updated Terms and update the "Last updated" date. Your continued use of the Platform after such changes constitutes acceptance.

15. Governing Law & Severability

These Terms are governed by the laws of the State of Illinois, without regard to its conflict-of-law provisions. If any provision is found unenforceable, it will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in effect.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Love What You Fund regarding the Platform.
